An internship letter has one job the employment letters do not: making clear that this is not employment. A vaguely worded internship that looks like a job, with fixed hours and supervision, is a misclassification risk.
The other clause worth getting right is the pre-placement offer. Saying nothing is read as a promise; saying something ambiguous is worse.
Frequently asked questions
- Do interns need an offer letter?
- Yes. It is what defines the engagement as training rather than employment, fixes its duration, and puts confidentiality and intellectual property on a written footing. Without one the relationship is whatever a court later decides it looked like.
- Are interns entitled to provident fund or minimum wage in India?
- A genuine trainee or apprentice under a recognised scheme is generally excluded from provident fund. Someone called an intern who is doing an employee's job on an employee's schedule may well not be — the substance decides it, not the label.
- Should an internship letter promise a job?
- Only if you intend to be held to it. Say clearly either that a pre-placement offer may follow subject to performance and business requirements, or that none should be expected. Silence is read as the former.
