A warning letter that only lists the complaint is half a document. What makes it fair, and what makes it useful later, is the second half: what specifically must change, by when, and what happens if it does not.
The right to respond matters too. A letter that goes on file without the employee's account beside it is weak evidence of a fair process.
Frequently asked questions
- How many warnings before termination in India?
- There is no fixed number. What matters is that the process was fair — the concern was put to the employee, they had a chance to respond and improve, and the decision followed. For misconduct, a domestic enquiry is required regardless of how many warnings preceded it.
- Does an employee have to sign a warning letter?
- Signing acknowledges receipt, not agreement, and the letter should say so. If the employee refuses to sign, record that fact, have a witness note it, and send a copy by email so receipt is not in dispute.
- What makes a warning letter defensible?
- Specific facts rather than characterisation, a clear statement of what must change, a review date, and the employee's right to respond in writing with their response placed on file alongside the letter.
