A termination letter is read in two situations: by the employee, and later by anyone reviewing whether the decision was properly made. It has to be factual, specific about the reason, and clear about what happens next.
Where the reason is conduct, the enquiry has to have happened before the letter, not after it. Where it is performance, the letter is much stronger if the prior warnings can be referenced.

- What must a termination letter in India contain?
- The reason, the last working day, how the notice period is being dealt with, what the settlement will cover, and what has to be returned. Where the reason is misconduct, the letter should record that the required enquiry has taken place.
- Can an employee be terminated without notice in India?
- Only for misconduct, and only after the enquiry the law requires. Termination for any other reason requires notice or pay in lieu of it, and for workmen under the Industrial Disputes framework there are further requirements including retrenchment compensation.
- When must gratuity be paid after termination?
- Within 30 days of becoming payable, with interest for delay. It does not wait for the rest of the settlement, for asset returns, or for the employee to sign anything.
- Does a termination letter need to state the reason?
- It is strongly advisable. A letter with no reason is difficult to defend if challenged, and leaves the employee to supply their own explanation to the next employer.
