The date that matters is the confirmation decision, and it is the one most often missed. Probation that expires without a letter generally confirms the employee by default, along with the longer notice period their contract attaches to confirmation.
The other principle here: a surprise at the end of probation is a management failure, not a performance one. Every concern goes into the mid-point review, not the final one.

- What happens if probation is not confirmed on time?
- In most structures the employee is deemed confirmed once the period expires, including the longer notice period that confirmation triggers. Letting the date pass is a decision, just not a deliberate one.
- How long can a probation period be in India?
- It depends on the contract and on the applicable Shops and Establishments Act, several of which cap the total period. Three to six months is usual, with a single documented extension where more time is genuinely needed.
- Can an employee be terminated during probation?
- Generally on shorter notice than a confirmed employee, per the contract — but the process still has to be fair, and the protections for workmen under the Industrial Disputes framework may still apply. Take advice before a probation termination that could be contested.
